SERVICES OFFERED BY THE THE PURI HOTEL ON THIS WEBSITE AND TERMS AND CONDITIONS GOVERNING THE SERVICES

DEFINITIONS :
In this agreement the following words shall have the following meanings/interpretation/full form :

"e-Reserve" means the name of the online reservation system developed and hosted by Luminous Infoways Pvt. Ltd. Bhubaneswar and licensed to PURI HOTEL
"Website" means the official website of PURI HOTEL viz., www.purihotel.in
"User" means an individual, firm or entity who have accessed the portal/website of PURI HOTEL and having read and accepted the terms and conditions of usage of the portal/website by clicking on the 'accept' button.
"e-voucher" means any electronic confirmation issued by us, through your use of our accommodation booking portal/website for your selected days of stay over the accommodation specified by the "PURI HOTEL". This could be an e-voucher you get printed from the portal/website, or what is obtained from authorized agents/franchisees of PURI HOTEL.
"Booking Number" means the unique 11 alphanumeric characters generated by the system on each and every successful booking.
"Payment Gateway" means the website of the credit and debit card processing bank where you will be furnishing your credit and debit card details for making payment towards the cost of service you have availed using our website.

SERVICES OFFERED:
The services offered by PURI HOTEL on their portal/website (www.purihotel.in) are specified below. The same services will also be available through their authorized agents/franchisees at various locations. However these service providers may have made different restrictions / limitations in the packages offered and PURI HOTEL is not responsible for any such limited service offered or for such differences in service between any two or more such service providers.

Advance reservation in any type or class of accommodation, which are offered by PURI HOTEL on full payment for both adults and children, for accommodation on any available dates and room vacancy on any of their resorts, subject to terms of booking specified by PURI HOTEL.
General enquiries such as accommodation availability, tariff for various types or class of accommodation offered by PURI HOTEL, check-in and check-out timings, discounts and packages offered , etc.
On line cancellation of booked accommodations subject to cancellation rules set by PURI HOTEL and the credit card issuing bank.
Issue of duplicate reservation vouchers.
Change of stay date and amendments to the bookings made subject to certain charges for change in stay dates.

TERMS AND CONDITIONS OF SERVICE.

PURI HOTEL provides the facility for transacting, reservations and issue of e-voucher of accommodation booked through the internet and through the online reservation system. Reservation and booking of accommodation and all transactions through this portal/website shall be governed by special conditions imposed for internet based booking and by conditions set out by PURI HOTEL from time to time.

The following terms and conditions will apply if you wish to use the portal/website of PURI HOTEL's online reservation service . Please go through the conditions carefully and if you accept them, you may register and transact on the portal/website. Please note that a person or firm or entity cannot register on the portal/website more than once. Also please note that by registering yourself, you are deemed to have read and agreed/accepted all the terms and conditions set forth here. In case you do not agree or accept any of the terms and conditions set forth here, please do not transact on this portal/website. Once you have clicked the 'I Agree' button on the bottom of this Terms and Conditions, or on the reservation pages, you have entered into a formal agreement with PURI HOTEL for the purpose of transactions on this portal/website.

PURI HOTEL's performance of this agreement is subject to existing laws and legal processes of Govt.of India, and nothing contained in this agreement is in derogation of PURI HOTEL's right to comply with law enforcement requests or requirements relating to your use of this portal/website or information provided to or gathered by PURI HOTEL with respect to such use. You agree that PURI HOTEL may provide details of your use of the portal/website to regulators or police or any other third party, or in order to resolve disputes or complaints which relate to the portal/website, at PURI HOTEL's complete discretion.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth herein, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

This agreement constitutes the entire agreement between the user and PURI HOTEL with respect to this portal/website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and PURI HOTEL with respect to this portal/website. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

ACCOMMODATION BOOKING

We agree to provide online accommodation booking facility to registered users who agree to the terms and conditions set forth in this agreement. The user can take a printout of the e-voucher and check-in at the hotel, without any further confirmation from PURI HOTEL. In all cases, please remember to carry a valid proof of identification. We will provide you the service with utmost care and professionalism. Booking of accommodation through the internet is available to registered users 24 hours a day and all the 7 days of the week. Nevertheless, service hours are liable to changes without any prior intimation.

ISSUE OF e-vouchers.

User Registration : You must be a registered user to use our portal/website to reserve, book and print any e-voucher and for any type of accommodation. Only persons above the age of 18 can register as a user. A user can register only once on this portal/website. All payments towards the cost of the accommodation and the service charge, if any, will be through AXIS Bank or any other payment gateway provided in the payment page of the portal/website. The portal/website is VeriSign secured and your credit/debit card details is transmitted through the internet in a fully encrypted (128 bit, browser independent encryption) form. Further, your credit card account details are not stored in our portal/website. You will be redirected to the payment gateway maintained by the credit card processing bank to furnish details of your credit card. Upon successful payment with the credit card processing bank, you will be redirected to our website from where you can print out the e-voucher.The misuse of Credit Card/ Internet Banking Access details is a criminal offence under Indian 'The Information Technology Act, 2008'. We will aggressively pursue and prosecute all transactions that attempt misuse of Credit Card/ Internet Banking Access details. As part of our strict security checks we track every transaction for its genuineness . The IP address of every registered user of this website/portal will be recorded by us as also date and time of usage.Accommodations can be booked upto a reasonable time set by PURI HOTEL. PURI HOTEL makes no guarantee that any service will be uninterrupted, timely, secure or error-free.
A registered user can chose his type of room and type of accommodation or packages offered from time to time from the selection. Your booking will be confirmed online and on successful receipt of payment from the payment gateway viz., AXIS Bank or any other payment gateway, the system will generate a unique Reference number or Booking Number for each booking. Booking of accommodation is subject to realization of the full tariff and the service charge and other taxes and levies, if any, from the payment gateway viz., AXIS Bank or any other payment gateway. You will be responsible for all charges, fees, duties, taxes and assessments arising out of your use of this portal/website. If, for any reason, the booking does not materialize, the entire amount debited from your credit/debit card account will be credited back to your account. If you want to try for the same booking again, it will be treated as a fresh one. If for any reason, you are not able to print out the booked accommodation, you will find the details of the booked accommodation on the left menu under 'booked history' from which link you can take a print out. Each booked accommodation will have a unique booking number. Please also carry a proof of identification for verification by PURI HOTEL personnel. PURI HOTEL personnel have the right to refuse accommodation if guest/s are different from the original booking. PURI HOTEL and their officials are not responsible for any wrong bookings due to incorrect details furnished by the user.

YOUR OBLIGATIONS :

You shall access our portal/website only for lawful purposes and you shall be responsible for complying with all applicable laws, statutes and regulations in connection with the use of our portal/website. This portal/website is for your personal and non-commercial use. You shall not modify, edit, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information, products or services obtained from this portal/website. You shall not create a hyperlink to the portal/website or 'frame' the portal/website, except with the express advance written permission of PURI HOTEL and or e-Reserve.

All information provided by you on the 'registration page' must be accurate and complete and all fields marked * (mandatory) must be filled. PURI HOTEL reserves all rights to disclose any or part of such information's provided to satisfy any applicable law, authorities, legal processes, any central/state/local government/bodies. You may use this portal/website only for legitimate bookings and you may not use the same for any sort of commercial resale and profit. Without limitation, any speculative, false or fraudulent booking in anticipation of demand is prohibited and PURI HOTEL has the right to refuse accommodation of such guests with such e-vouchers.
Non-authorization of payment more than twice by the payment gateway for accommodation booked by you is liable to result in cancellation of your registration with us and will be done without any notice to you.
By registering with us, you confirm that you are of legal age as prescribed by law to enter into such agreements and that all the information you have provided to us at the time of registration is true and to best of your knowledge and belief. You are responsible for the security of the 'user name' and 'password' sent to you upon the first registration and since these are transmitted on encrypted mode, even PURI HOTEL/e-Reserve will have no knowledge about the same. PURI HOTEL will not be responsible for any financial loss, inconvenience or mental agony resulting from misuse of your user id/password/credit, debit card number/account number details for bookings made on this portal/website.PURI HOTEL shall use reasonable endeavors to check the accuracy of the information posted on this portal/website for their Resorts, but give no warranty as to the accuracy of such information and reserve the right to amend and vary the contents of this portal/website from time to time without prior notice. The portal/website may also contain links to third party websites and which are not under the control of PURI HOTEL and as such PURI HOTEL will not be responsible for the contents of such sites, including without limitation any link contained in a linked site or any changes or updates to a linked site. PURI HOTEL will not be responsible for any transactions with such third party links including advertisers or promotional offers, services, payment for delivery of goods/services etc and is solely between you and the third party link promoters. PURI HOTEL will not be responsible or liable for any part of such dealings or promotions. The maximum amount of our liability to you for all loss or damage arising out of use of our portal/website and the service whether in contract or tort shall be limited to the value of the accommodation booked and paid for through your use of this service.
PURI HOTEL shall not be liable to you in respect of any short coming in performance of these terms and conditions or breach of the terms and conditions due to any event or circumstances beyond our reasonable control.
PURI HOTEL may at any time at our sole discretion and without giving any reason or any prior notice terminate or temporarily suspend your access to all or any part of the portal/website.
This agreement and your use of the portal/website is governed by Indian Law and the courts of Puri, India. You hereby irrevocably consent to the exclusive jurisdiction and venue of courts in Puri and all disputes arising out of relating to the use of the PURI HOTEL portal/website. This agreement including any document referred to herein constitutes the entire agreement between us and you in respect of your use of this service. All content and software that is made available to view and/or download in connection with the PURI HOTEL sites/services, excluding content and /or software that may be made available by end users through a communication service is owned by and is the copyrighted work of PURI HOTEL and Luminous Infoways Pvt. Ltd. Bhubaneswar and/or its suppliers and is protected by copyright laws and international treaty provisions.
Nothing in this agreement shall operate so as to create a partnership, joint venture, an agency relationship or employment of any kind between you and us. All rights not expressly granted herein are reserved.
